what will happen when i go to court? realy scared of jail!?ok i live in lepanto arkansas,and last year this guy broke in my car and stole my cd player and speakers and stuff. i went to the cops but they did nothing. the guy has been in trouble lots of times before and the cops do nothing. and it pissed me off. so i broke in his house and stole some things from him to get back at him.. the cops had asked me some questions. and i told them yea it was me and i confessed to everything. and i gave everything back. and i explained why i did it and everything.i had to spend the night in jail and the next day i seen the judge and he let me go with my granmals super vision. and gave me a court date of this coming up monday. i am 19 years old and i have a 7 month old baby and im in college, a technical college. i have never been in any kind of trouble like this before, only small traffic tickets. i am scared to go to jail because i have my girl friend and my baby to take care of.. what do y'all think will happen to me? i am real scared!

Well. You were an idiot, but fortunately you knew you were an idiot because you cooperated fully with the police.

Burglary is a serious felony and it's one that COULD result in prison time. But if what you've typed is correct and I were the prosecutor on the case I would be willing to offer you a deferred prosecution. (Essentially, you plead guilty and submit a full confession. Then you jump through hoops, pay fines, do community services, and keep your nose completely clean for a specific period of time. If you fulfill all of these, then charges would be dismissed and you wouldn't even have a conviction on your record.)

I'm assuming that your Monday hearing is the Show Cause Hearing, is that right? I'm guessing you have not already entered a plea, correct? You will need to enter a plea of "not guilty." (Yes. I know you are guilty, but this will be the plea you need to enter.) Hopefully you'll have a public defender at the hearing who will enter this plea on your behalf. You will NOT be going to jail on Monday. This is a formality. Plus, if the judge was inclined to keep you locked up you wouldn't be out right now.

My prediction is that you'll be offered a reduced charge or the deferred prosecution. I hope you take advantage of the second chance and will focus on being a great father to your baby. Good luck.

Wow, I think you should get your-self a really good lawyer. I don't think the police will show you any leniency in this case, since he or she already charge you and decided to bring you to a judge. The charge is probably not just theft, you broke inside someones place that is B & E which is serious. Remember your wife and kid need you. I don't know the law there so I may not be able to help you. According to what you said, you voluntarily provided the police a confession and that is the main evidence of the crown's case. I hope for your sake the police did not provide you with a police warning before your confession and if that is the case you might get off on a technicality. Good Luck
